Resolution of the VR. On the Report on the Execution of 1994 State Budget of Ukraine

The Verkhovna Rada of Ukraine resolves:

 

1. To determline the work of the Government of Ukraine in execution of 1994 State Budget as unsatisfactory.

2. To take into consideration the report of the Prosecutor’s General Office dated May 17, 1996 “On thel Results of Oversight of the compliance of the Law of Ukraine “On the 1994 State Budget”.

3. To form a Provisional Investigative Commission of the Verkhovna Rada of Ukraine together with the Prosecutor’s General Office of Ukraine to check up the violations of the Laws of Ukraine On the 1994 State Budget and On the 1995 State Budget and to define the officials guilty in the non-compliance of the above mentioned Laws.

4. To confirm the Membership of the Provisional Investigative Commission of the Verkhovna Rada of Ukraine to examine the violations of the Laws of Ukraine On the 1994 State Budget and On the 1995 State Budget.

5. The Provisional Investigative Commission shall report to the Verkhovna Rada the results of the examination of the violations of the Law of Ukraine “On the 1994 State Budget”.

6. In order to prevent violations in the execution of the State Budget of Ukraine in the future, the Cabinet of Ministers of Ukraine together with the Prosecutor’s General Office shall draft and submit to the Verkhovna Rada of Ukraine their proposals on the legal mechanism that would identify the responsibility of the members of the Government and of other officials guilty in the violation of Budget observation.

Resolution of the VR. On the Report on the Execution of 1995 State Budget of Ukraine

The Verkhovna Rada of Ukraine resolves:

1. Not to confirm the Report on the execution of the 1995 State Budget of Ukraine.

2. To note that violations of the Law “ On the 1995 State Budget Law of Ukraine” have taken place in course of the execution of the 1995 State Budget, in particular:

  • Budget deficit caps are exceeded by 39,2 trillion krb;
  • Cabinet of Ministers of Ukraine has obtained credits in the National Bank of Ukraine by 50,3 trillion krb more than was sanctioned by the Law;
  • budgetary funds foreseen for some expenditures are used in volumes that exceed the sanctioned expenditure caps, and at the same time some expenditures foreseen by the Law On the State Budget are not financed at all. These were made possible as a result of the promulgation of statutory acts and decrees by the Government of Ukraine which, contrary to the exclusive competence of the Verkhovna Rada of Ukraine, changed the expenditures foreseen by the law.

3. The Provisional Investigative Commission together with the Prosecutor’s General Office shall examine the execution of the Law of Ukraine “On the 1995 State Budget” and report to the Verkhovna Rada the results of this examination in October 1996.

4. In order to prevent violations in the execution of the State Budget of Ukraine in the future, to ask the President of Ukraine:

  • to appoint an official in the Government who will bear the personal responsibility for the execution of Budget revenues and who would have necessary authority for this purpose;
  • to take measures to prevent the violations in course of execution of the State Budget in the future.
