DECREE OF THE PRESIDENT OF UKRAINE number 548/2011

On immediate measures to ensure access to public information in subsidiary organs formed by the President of Ukraine

To ensure the implementation of the Law of Ukraine "On access to public information" and guided by the second paragraph of Article 102 of the Constitution of Ukraine, resolve:

 

1. To identify the Main Directorate for Ensuring Access to Public Information of Administration of the President of Ukraine a special department which organizes the established order of access to public information is responsible for reviewing, processing, registering, ordering, analyzing and responding to requests for information received by the President of Ukraine, Administration of the President of Ukraine, as well as providing advice during processing of such requests.

 

2. Head of Presidential Administration of Ukraine:

 

1) to take urgent organizational measures to ensure in the Administration of President of Ukraine, in the established order, access to public information, including:

 

develop and approve the form of requests for information, instructions for filing a request for information and receipt, order of their assembly, for requests submitted verbally, in writing or other forms (mail, fax, phone, email);

 

introduce a registry of requests for information;

 

identify specific areas for those people requesting documents that contain public information, a copy of them to provide appropriate equipment for such places;

 

create the conditions for submission of written requests for information by citizens with disabilities;

 

to create access to public information and a storage system for registering documents containing public information, provide mandatory registration of this system in such documents and provide access to it on demand, publishing on the website of the official Web site of President of Ukraine information about existing documents that contain public information;

 

2) provide a systematic and prompt publication and update on the activities of President of Ukraine;

 

3) Ensure the notification in official publications, the website of the official Web site of President of Ukraine, information stands in special places for those requesting the information specified in Article 15 of the Law of Ukraine "On access to public information, information request form;

 

4) approve the list of information that is official information held by the President of Ukraine and is used in the Administration of the President of Ukraine;

 

5) approve the Regulations on the registration, storage and use of documents and other data carriers that contain information that is public information;

 

6) provide training and higher professional training for employees of the Main Directorate of Access to Public Information Administration of the President of Ukraine on ensuring access to public information.

 

3. State Affairs Department:

 

1) in the established manner take immediate steps to ensure the financing of costs associated with implementation of the Law of Ukraine "On access to public information”;

 

2) submit within a week after approval by the Cabinet of Ministers of Ukraine regulations on the limits of the cost of copying and printing documents, suggestions for determining the actual costs of making the Department of Access to Public Information Administration of the President of Ukraine copies of more than 10 pages that are provided when a request for information is satisfied.

 

4. Amend the Regulations on the Administration of President of Ukraine approved by the Decree of President of Ukraine dated April 2, 2010 № 504, changing, amending paragraph 4, subparagraph 191 as follows:

 

"191) through the Department provides access to public information in the established manner, access to public information, review, processing, accounting, ordering, analyzing and responding to requests for information received by the President of Ukraine and the Administration of President of Ukraine, advice during the registration of requests.

5. State Affairs Department, the Council of National Security and Defense Council of Ukraine of President of Ukraine in the Crimea, the State Fund for Assisting Local Self-Government in Ukraine, of the National Prize of Ukraine Taras Shevchenko, the Committee on State Prizes of Ukraine in Science and Technology Committee Ukraine State Prize in architecture, Coordinating Center for the introduction of economic reforms, the National Tripartite Social and Economic Council, the National Mediation and Conciliation Service, the National Institute for Strategic Studies, National Academy of Public Administration of Ukraine to take measures on unconditional fulfillment of the Law of Ukraine "On access to public information ".

 

6. The decree takes effect after its publication.
